A man has been charged in federal court with attempting to use an explosive device to damage a Naperville restaurant over the summer during civil unrest following the police killing of George Floyd in Minneapolis.

Diego Vargas, 24, was charged in U.S. District Court in Chicago this week with a single count of maliciously attempting to damage and destroy a building by means of an explosive device.

According to an indictment unsealed Thursday, Vargas allegedly used the explosive at the Egg Harbor Cafe in Naperville on June 1.

Court records indicate Vargas was previously charged with attempting to steal an ATM with two other accomplices in Aurora on May 31.

Vargas is currently being held at the Metropolitan Correctional Center in Chicago and was scheduled for a detention hearing Friday afternoon.

If convicted, he faces a minimum sentence of five years in federal prison and a maximum of 20 years.
