James Callion, 28, has been charged with three counts of attempted first-degree murder, two counts of unlawful use of a weapon by a felon as well as single counts of armed habitual criminal and aggravated battery causing harm to a police officer.

He was shot multiple times by police during the encounter and did not appear in court for a hearing Wednesday as he remains hospitalized at the Mount Sinai Medical Center.

The incident began around 9:15 p.m. Monday night when officers saw a 2006 Pontiac Grand Prix allegedly driven and owned by Callion commit a minor traffic violation near the intersection of South Sacramento Avenue and West Polk Street.

According to Assistant State’s Attorney Danny Hanichak, the officers let that infraction go, but then attempted to pull the vehicle over when it later ran a stop sign. The officers activated the lights on their unmarked squad car and pulled in front of Callion, who then attempted to reverse and get away, Hanichak said.

A second Chicago police squad car then pulled behind Callion’s vehicle, and he attempted again to drive forward, but was stopped by the first squad car, Hanichak said.

As officers approached Callion’s vehicle, they smelled marijuana and saw an open alcohol container between his feet, Hanichak said. One officer attempted to calm Callion, asking him to put the car in park and telling him the situation was “no big deal,” according to Hanichak.

But when another officer announced that he could see a handgun inside the car next to Callion, he allegedly put the car back into drive and accelerated into an officer who was standing before him, pinning him between the Grand Prix and a squad car.

Callion then fired his gun once through his front windshield at that officer and through a passenger window at another officer, but missed, Hanichak said. Both of those officers drew their own weapons and fired into the car, striking Callion multiple times, according to Hanichak.

When a third officer reached into the car to try and grab Callion, he allegedly fired once more, striking that officer in the hand. Police were then able to get Callion out of the car and place him under arrest while an ambulance was called.

Investigators recovered three .40 caliber shell casings from inside the vehicle, Hanichak said, as well as five 9mm casings outside of it that were fired by police. Police also said they recovered two firearms from Callion.

The shooting was recorded on the body-worn cameras of all three officers, as well as a police pod camera nearby.

The officer who was shot in the hand must undergo surgery to remove bullet fragments, according to Hanichak, while the officer who was pinned between the vehicles suffered a broken fibula and is expected to be bedridden for at least 12 weeks.

While he suffered “serious” injuries from the shooting, Callion has since been stabilized.

During Wednesday’s hearing, Hanichak said Callion has six prior felony convictions for robbery and burglary, most recently in 2014.

Judge Mary Catherine Marubio temporarily denied bail for Callion until he is released from the hospital and can be present for a hearing. A status check has been scheduled for Friday.
