Prosecutors late Tuesday filed their response to Madigan’s co-defendant, Michael McClain, whose attorneys last month filed a motion seeking to sever his case from Madigan’s before the men are set to go to trial on racketeering charges later this year.

The federal lawsuit was filed on Tuesday in the U.S. District Court for the Northern District of Illinois. According to the complaint, the five plaintiffs claim they were unfairly targeted by off-duty police officers who work as security guards at the Home Depot store at 47th Street and Western Avenue.  

Amin Betuni, 37, of Palos Hills, entered into a plea agreement with federal prosecutors, admitting that he shipped items on three occasions in 2022 in violation of federal export regulations.

Charles Cui, 53, of Lake Forest, was convicted in December alongside Ed Burke of one count of federal program bribery, three counts of using interstate commerce to facilitate an unlawful activity and one count of making a false statement to the FBI. 

“Right now, there’s over 420 residents at Stateville who are at risk of dire injury due to the structural vulnerabilities, degradation and deterioration of those buildings that put them at risk of serious physical injury,” said Heather Lewis Donnell, a partner at Loevy and Loevy.

The lawsuit filed by John Velez, who spent 17 years in prison before his conviction in the murder of 26-year-old Anthony Hueneca in Little Village was overturned, is set for trial for July 2025, U.S. District Court Judge Edmond Chang ruled Tuesday.
